Munchables holds the intellectual property rights over and makes available a) The Munchables game, including the DApp and the Web App, (the ‘Services’) and b) the Munchables website available at https://munchables.app/ (the ‘Site’). By using the Services or the Site, you acknowledge and agree to be bound by these Terms. If you do not accept these Terms, you must not use the Services.
Munchables holds the intellectual property rights over and makes available a) The Munchables game, including the DApp and the Web App, (the ‘Services’) and b) the Munchables website available at https://munchables.app/ (the ‘Site’). By using the Services or the Site, you acknowledge and agree to be bound by these Terms. If you do not accept these Terms, you must not use the Services.

In order to use the Services, you must be fully able and competent to fully enter into the agreement set out in these Terms. In particular you represent and warrant that:
you are a) at least 18 years of age and b) of the legal age of majority in your jurisdiction as is required to use the Services;
your use of the Services complies with all applicable laws and regulations in your jurisdiction; and
any funds and assets used by you in the Services have been lawfully attained by you.
In order to use the Services, you must be fully able and competent to fully enter into the agreement set out in these Terms. In particular you represent and warrant that:

Munchables reserves the right to take reasonable measures to prevent the creation of automated accounts. In order to create an Munchables account, you must lock cryptocurrency (‘Locked Crypto') in the DApp. You acknowledge that:
Locked Crypto in the DApp will be automatically processed, and neither Munchables nor any other party has discretion to affect such processing; and
Munchables may receive rewards, including but not limited Blast tokens, in proportion to the quantity of Locked Crypto in the Munchables Smart Contract, and you have no claim to such rewards.
Your Account will be authenticated using the wallet you use to access the Blast chain (your ‘Blast Wallet’). Munchables has no control over the security of your Blast Wallet, and accepts no liability for any compromise to it.
Munchables reserves the right to take reasonable measures to prevent the creation of automated accounts. In order to create an Munchables account, you must lock cryptocurrency (‘Locked Crypto') in the DApp. You acknowledge that:
Locked Crypto in the DApp will be automatically processed, and neither Munchables nor any other party has discretion to affect such processing; and
Munchables may receive rewards, including but not limited Blast tokens, in proportion to the quantity of Locked Crypto in the Munchables Smart Contract, and you have no claim to such rewards.
Your Account will be authenticated using the wallet you use to access the Blast chain (your ‘Blast Wallet’). Munchables has no control over the security of your Blast Wallet, and accepts no liability for any compromise to it.

You will be assigned a Munchable upon providing Locked Crypto for the DApp.
Munchables does not provide facilities for transferring Munchable NFTs, but you can transfer your Munchable as you would any other NFT on the Blast chain. Munchables has no insight into or control over such transfers and, consequently, has no ability to oversee, validate or reverse such transfers.
Munchables may dispense future rewards to users of the Services. The form and distribution of such rewards is entirely at our discretion.

To the greatest extent allowed by applicable law in your jurisdiction:
Munchables excludes all liability (whether by contract, statutory duty, tort or otherwise) for any special, indirect or consequential loss;
Munchables’ maximum liability (whether by contract, statutory duty, tort or otherwise) will be limited to the value of your Locked Crypto at the time of the breach giving rise to such liability;
Your use of the Services exposes you to particular risks for which Munchables accepts no liability. These include but are not limited to:
Financial Risks. Cryptocurrencies may rapidly gain or lose value, and may lose their entire value. Locking cryptocurrencies may affect your ability to take advantage of such gains, or to mitigate such losses.
Security Risks. The security of smart contracts and the assets they hold depends upon the security of the underlying software development process. Whilst we make reasonable efforts to ensure that the DApp is developed in accordance with good industry practice, we accept no liability for losses resulting from a breach to the security of the DApp unless caused by our negligence or wilful misconduct.
Privacy Risks. Using the Services, as with all transactions on the Ethereum blockchain, involves the public disclosure of financial information associated with your wallet address. To the extent that your wallet address can be associated with you, this may compromise your privacy. Whether and to what extent it is possible for other parties to make such associations is your sole responsibility. Munchables’ will not be liable for any loss or harm resulting from your failure to take reasonable measures to protect your privacy whilst using the Services.
Regulatory Risks. The distributed ledger technologies through which the Services are enabled are subject to significant regulatory uncertainty in some jurisdictions. Munchables will not be liable for any losses to you resulting from our good faith efforts to comply with applicable law. For certainty, such efforts may include the withdrawal of the Services from certain jurisdictions, or the cessation of the Services.

All intellectual property rights in the Services are owned by Munchables or our licensors.
Subject to clauses 7.2 and 7.3, Munchables grants you a limited licence to use the Services for the purpose of participating in the Munchables game.
Where you own a Munchable NFT, Munchables grants you a limited licence to use the character art associated with such NFT, including the making of derivative works, provided that such use:
accords with applicable law;
does not compete, directly or indirectly, with Munchables’ business interest in the Services; and
accords with any acceptable use policy we may publish.
You may make use of Marks solely for the purpose of attributing the origins of your Munchable NFT. Munchables may revoke the licence granted under this clause where we reasonably believe you have breached any of your obligations under this clause.
